eBay Terms & Conditions
Terms and Conditions are set out in the form of Frequently Asked Questions.
I assume that all bidders have read and agreed to the issues raised here.

IMPORTANT: Non-UK bidders winning an item for £150 or more will incur a surcharge on their total, and must therefore read the section in RED below...

Paypal
or Cheque
or Postal Order
or Direct Bank Transfer (any charges to be met by you)

USA-based buyers:

or Money Order (in GBP)
or personal check in Dollars (please check with us first, as there will be a surcharge to cover bank charges)

or Direct Bank Transfer (any charges to be met by you)

I do not take credit card or BidPay payments.

Q: How much is the shipping ?

A: For most items this is clearly stated on the auction, and will sometimes be zero. If I consider the item most likely to sell in the UK then I may have only quoted for domestic shipping, so please ask for a quote to where you live. I believe that all eBay auctions should be truly international and, though based in the UK, will ship anywhere in the world. The stated price does not include insurance, which is usually voluntary.

Q: What happens at the end of the auction ?

A: On completion of the auction I expect most buyers to pay with Paypal, or to request our address so that a cheque may be sent. An invoice can be sent if required, but I do not always do this routinely. If I have not heard from you after a day or two I will attempt to contact you. However, if I have still not heard from you within five days of the end of the auction, I reserve the right to sell to the underbidder, so if you are going away, please let me know before you bid. Please note that MOST communication will be by email, not eBay's messaging system, so it is important that you keep your details updated. Equally, I print address labels from the information provided by eBay at the close of the auction, so if this address is not correct it is your responsibility to change it.

Q: Is the shipping of this item insured ?

A: This depends on the amount of the winning bid...

a) under £39: I obtain a proof of posting for all items sent, which includes free insurance cover for items up to £39 in value, technically only within the UK, although I have successfully claimed for items sent overseas in the past.

b) between £39.01 and £149.99: The item is not automatically insured, although the Proof of Posting Certificate should in theory mean that I can make a claim for loss or damage on your behalf, but the maximum payout will be £39. Unlike some sellers I do not automatically make you pay for insurance, but this means that YOU assume the risk, and must understand that you are only covered for the first £39. The only way to insure within the UK is to use Special Delivery, the cost of which starts at around £5. I will gladly add the extra for insurance - just ask for a revised invoice.

c) £150 or over: Because of a condition in the small print of Paypal's contract with me, I sadly have to insist that all items sold for £150 or over must be sent by a method which requires a signature on delivery. In the UK this means using Recorded Delivery, at no charge to yourself, but this method does not include insurance, so you are advised to pay the extra for Special Delivery (see above). Overseas, the service used will be Signed For delivery, which includes some insurance but not necessarily covering the full value of the item. the cost of sending by this service will be met by you. If you have already paid for just the item I will send a further Paypal invoice to cover the Signed For delivery, and the item will not be sent until this is paid. The only way to avoid this add-on cost is to use an alternative method to pay for your item, ie not Paypal.

If you choose NOT to insure that is your choice, but if it then does not arrive you must assume responsibility for its loss. We will always have documentary proof that it was handed to Royal Mail for delivery, and if neccessary will produce this in Court in the event of a clawback of funds on grounds of non-delivery.

Q: What happens if the item is lost or broken ?

A: Very few items are lost and we pack very well so do not expect you to receive a damaged item. However, you should insure any item sent overseas or any item sold for over £39 and sent within the UK, if you want to guarantee compensation. We cannot accept any responsibility for loss or breakage of items if not insured, though would consider carefully any evidence of negligence on our part. In the event of an insured breakage claim you would need to return the item to the Royal Mail, and it will remain their property if compensation is paid. Compensation, if paid, will include the costs of postage.

Q: Can I get my item quickly ?

A: Special Delivery items are guaranteed to arrive at most UK destinations by 1pm the day after posting. For International mail the only fast option is a courier, which is VERY expensive -much more than a courier from the States to the UK. Also, please note that I only go to the Post Office twice a week, and reserve the right to wait for your cheque to clear before mailing the item. Even items paid for by PayPal may not be mailed for a few days, especially if you have waited a day or more before paying after the auction ended.. If you need the item urgently - tell me!

Q: Can you include an invoice or receipt ?

A: Packages are often sent abroad by "small packet" rate. This is much cheaper than regular airmail, but it a condition of shipping that no paperwork can be enclosed. As your parcel will probably have been sealed before I knew its final destination, it will contain just your item or items. I can send a receipt, but please send a stamped addressed envelope with your payment, or request an unsigned one by email.

Q: The auction ended over three days ago, and I've not heard from you - why ?

A: Some ISPs (including AOL) have on occasion blocked all emails from my ISP (which is actually one of the best UK companies). If you have a twitchy service provider, with over-vigilant spam filters, and are surprised that we have not been in touch lately, then please contact us by another method (e.g. request our phone number from eBay). I have an emergency email address which can be used, but will only give this out if I am aware there is a problem.

Q: Have you got another item like that ?

A: I am often asked, after completion of an auction, if I have another similar item for sale. This is usually because the bidder tried to bid at the last minute and either forgot, or their sniping software failed. I'd therefore encourage everyone to bid early if possible, even if just a holding bid. EBay will not allow messages from a seller to underbidders after the auction, but will allow me to list the item for a "second-chance-offer". Of course, I can only do this if you are the underbidder. So, yes, it is possible I do have another, so bid early !

Q: Do we have a legal contract ?

A: Once an auction ends, Stage Memories agrees to sell the item to the high bidder at the price shown, and by winning the auction you will be entering into a legal contract to purchase the item at that price. Non-compliance with that contract will result in an action in the small claims court to recover the funds, although every attempt will first be made to settle out of court. The only exception to the establishment of a legal contract is if there has been a breakdown at eBay during the last hour of the auction, making last minute bids impossible. EBay will only extend an auction if there has been a general breakdown of 2 hours or more, but I feel that it is reasonable that last minute bidders should be physically able to place their bids. Therefore if an auction was not visible during the last minutes of an auction I consider it to be null and void, and that I am under no obligation to sell to the high bidder. In this circumstance I will relist the auction, starting at the same (or lower) price.
